JIU JITSU PRIVATE LESSON WAIVER AND ASSUMPTION OF RISK
Effective date: October 15, 2026
This Jiu Jitsu Private Lesson Waiver and Assumption of Risk (Waiver) applies to the participant identified in the acceptance record (Participant) and is given to Furious Stylez LLC and its owners, coaches, employees, contractors, and authorized facility personnel (Furious Stylez). The adult Participant, or the Participant’s parent or legal guardian when the Participant is under 18, is the Signer.
This Waiver concerns physical participation. Purchase, scheduling, billing, cancellation, and product rules are governed by the applicable Private Lesson terms or membership agreement.
SECTION 01
Nature of participation
Jiu Jitsu is a combat and grappling activity involving close physical contact. Instruction may include warmups, mobility work, takedowns, throws, falls, pins, escapes, sweeps, joint controls and locks, choke or strangulation techniques, positional sparring, live resistance, conditioning, and use of mats or training equipment.
The Participant may decline or stop an activity and must immediately follow a coach’s instruction to stop.
SECTION 02
Acknowledgment of inherent risks
The Signer understands that participation can cause injury even when reasonable instruction and safety practices are used. Risks include, without limitation:
- slips, trips, falls, collisions, awkward landings, and contact with people, mats, walls, or equipment;
- bruises, abrasions, mat burns, sprains, strains, dislocations, fractures, dental or eye injury, and concussion or other head injury;
- injuries involving the neck, spine, joints, muscles, ligaments, nerves, or internal organs;
- temporary loss of consciousness or injury associated with choke or strangulation techniques;
- fatigue, overheating, dehydration, aggravation of a known or unknown condition, communicable illness, and allergic reaction; and
- in rare cases, permanent impairment, paralysis, or death.
The exact occurrence and severity of an injury cannot be predicted or eliminated.
SECTION 03
Voluntary assumption of risk
The Participant chooses to participate voluntarily. The Signer knowingly accepts the inherent and reasonably foreseeable risks of the approved activities, including risks arising from the Participant’s actions, another participant’s actions, ordinary mistakes, and the physical nature of instruction.
This assumption does not waive a right that applicable law does not permit the Signer to waive.
SECTION 04
Safety, Injuries, Limitations, and Disclosure
The Signer represents that the information supplied about the Participant’s health, injuries, restrictions, limitations, or safety concerns relevant to emergency response, and readiness is accurate to the Signer’s knowledge. The Signer will promptly report a material change before further participation.
Furious Stylez does not diagnose medical conditions or determine medical fitness. When the Participant or a qualified healthcare professional has identified a restriction, the Participant must follow it. The Participant must not participate while impaired, contagious, unable to follow safety directions, or experiencing symptoms that make participation unsafe.
SECTION 05
Safety duties
The Participant agrees to:
- follow reasonable coach and facility instructions;
- use required protective equipment when directed;
- promptly communicate pain, dizziness, breathing difficulty, injury, unsafe conditions, or inability to continue;
- release a technique immediately when instructed or when a partner submits;
- avoid reckless, retaliatory, malicious, or intentionally dangerous conduct; and
- stop participation when instructed.
Furious Stylez may modify, pause, or end participation when safety, conduct, readiness, or service fit requires it.
SECTION 06
Emergency response
If the Participant appears to need urgent assistance and the Signer cannot be reached promptly, the Signer authorizes Furious Stylez to contact emergency services and provide reasonably available emergency and guardian information. This authorization does not require Furious Stylez to provide medical treatment, guarantee a particular response, or assume responsibility for third-party medical decisions or charges.
The Signer remains responsible for the Participant’s medical, ambulance, hospital, and related expenses except to the extent applicable law places responsibility elsewhere.
SECTION 07
Release of claims
To the fullest extent permitted by Texas law, the adult Participant releases Furious Stylez from claims for personal injury or property damage arising from the inherent risks of the approved Jiu Jitsu activities or from Furious Stylez’s ordinary negligence in connection with those activities.
When the Participant is under 18, the parent or legal guardian releases the guardian’s own claims and, only to the extent Texas law permits a guardian to do so, claims the guardian is legally authorized to release for the minor.
This release does not apply to gross negligence, reckless or intentional misconduct, a claim that applicable law prohibits from being released, or a nonwaivable statutory right.
SECTION 08
No insurance or medical-expense promise
This Waiver does not represent that Furious Stylez carries medical insurance for the Participant and does not promise to pay a Participant’s medical expenses merely because an injury occurred during participation.
SECTION 09
Reporting injuries and safety concerns
An injury, unsafe condition, or misconduct concern should be reported promptly to the coach, to info@furiousstylez.net, or through the Furious Stylez Contact page. If someone is in immediate danger, call 911.
Furious Stylez may preserve necessary incident, witness, communication, and response records under its Privacy Policy and retention rules.
SECTION 10
Minor participants
For a Participant under 18, this Waiver must be accepted by the Participant’s parent or legal guardian together with the Minor consent form (Google Forms). The minor’s acknowledgment or assent does not replace the adult’s authorization.
Parent or guardian presence is preferred where appropriate. No separate media permission is created by this Waiver.
SECTION 11
Electronic acceptance and record
The Signer agrees to electronic acceptance and confirms the ability to access and retain this Waiver. The record may include the Signer and Participant identities, relationship, accepted version, timestamps, service, and related readiness or emergency record. A later prospective version does not silently replace the version accepted for an earlier participation period.
SECTION 12
Governing law, venue, and severability
Texas law governs to the extent it may lawfully do so. When a county-based venue provision is required and may lawfully apply, venue is Johnson County, Texas. If any provision cannot be enforced as written, it will be limited or separated only as necessary, and the remainder continues.
