PERFORMANCE COACHING WAIVER AND ASSUMPTION OF RISK
Effective date: October 15, 2026
This Performance Coaching Waiver and Assumption of Risk (Waiver) applies to the participant identified in the acceptance record (Participant) and is given to Furious Stylez LLC and its owners, coaches, employees, and contractors (Furious Stylez). The adult Participant, or the Participant’s parent or legal guardian when the Participant is under 18, is the Signer.
This Waiver concerns physical participation. Membership, billing, scheduling, and product rules are governed by the Performance Coaching Membership Agreement or applicable bundle agreement.
SECTION 01
Nature of activity
Performance Coaching may include strength, conditioning, mobility, flexibility, balance, agility, speed, power, endurance, recovery, body-composition support, exercise demonstrations, independent workouts, and use of weights, resistance devices, mats, cardio equipment, or other training equipment. Activity may occur in person or from a remotely delivered plan.
SECTION 02
Acknowledgment of risks
The Signer understands that exercise and athletic training involve risks that cannot be eliminated, including:
- fatigue, delayed soreness, overexertion, dehydration, overheating, dizziness, fainting, and shortness of breath;
- slips, trips, falls, collisions, equipment movement or failure, and incorrect or unassisted execution;
- sprains, strains, bruises, fractures, dislocations, head injury, and injury to muscles, joints, ligaments, nerves, spine, or internal organs;
- aggravation of a known or unknown medical condition or prior injury;
- risks arising because Furious Stylez cannot physically control the Participant’s environment, equipment, supervision, or execution during independent or remote activity; and
- in rare cases, serious permanent injury or death.
The Participant may decline or stop an activity and must stop when instructed or when symptoms make continued activity unsafe.
SECTION 03
Voluntary assumption of risk
The Participant chooses to participate voluntarily. The Signer knowingly accepts the inherent and reasonably foreseeable risks of the approved activities, including risks arising from the Participant’s actions, equipment, surroundings, another person’s actions, ordinary mistakes, and the physical nature of training.
This assumption does not waive a right that applicable law does not permit the Signer to waive.
SECTION 04
Health, readiness, and medical boundary
The Signer represents that health, injury, restriction, medication relevant to emergency response, and readiness information supplied for the Participant is accurate to the Signer’s knowledge and will be updated when materially changed.
Furious Stylez does not diagnose, treat, rehabilitate, prescribe, or determine medical fitness. Performance Coaching is not medical care, physical therapy, mental-health treatment, or medical nutrition therapy. The Participant is responsible for obtaining appropriate healthcare advice and following restrictions from qualified professionals.
The Participant must not begin or continue activity while impaired, contagious, experiencing alarming symptoms, unable to follow directions, or using an unsafe environment or equipment.
SECTION 05
Participant safety duties
The Participant agrees to inspect the immediate area and equipment, use appropriate space and footwear, follow reasonable instructions, use suitable resistance and intensity, avoid intentionally dangerous practices, and promptly report pain, dizziness, breathing difficulty, injury, equipment problems, or inability to continue.
For remote or independent activity, the Participant is responsible for arranging appropriate local supervision or assistance when the plan, age, ability, environment, or known condition makes it prudent.
Furious Stylez may modify, pause, or end an activity when safety, conduct, readiness, or scope requires it.
SECTION 06
Emergency response
For an in-person or live remote session, if the Participant appears to need urgent assistance and the Signer cannot be reached promptly, the Signer authorizes Furious Stylez to contact emergency services and provide reasonably available emergency and guardian information. Furious Stylez cannot guarantee the availability, timing, or outcome of emergency assistance, particularly during remote activity.
The Signer remains responsible for medical, ambulance, hospital, and related expenses except to the extent applicable law places responsibility elsewhere.
SECTION 07
Release of claims
To the fullest extent permitted by Texas law, the adult Participant releases Furious Stylez from claims for personal injury or property damage arising from the inherent risks of approved Performance Coaching activities or from Furious Stylez’s ordinary negligence in connection with those activities.
For a minor Participant, the parent or legal guardian releases the guardian’s own claims and, only to the extent Texas law permits a guardian to do so, claims the guardian is legally authorized to release for the minor.
This release does not apply to gross negligence, reckless or intentional misconduct, a claim applicable law prohibits from being released, or a nonwaivable statutory right.
SECTION 08
No insurance, medical-expense, or result promise
This Waiver does not represent that Furious Stylez provides medical insurance for the Participant and does not promise to pay medical expenses merely because an injury occurred. Furious Stylez does not guarantee a physical, performance, body-composition, competition, or injury-prevention result.
SECTION 09
Reporting and records
An injury, unsafe condition, or misconduct concern should be reported promptly to the coach, to info@furiousstylez.net, or through the Furious Stylez Contact page. If someone is in immediate danger, call 911.
Furious Stylez may preserve necessary incident, readiness, communication, and response records under its Privacy Policy and retention rules.
SECTION 10
Minor participants
For a Participant under 18, a parent or legal guardian must accept this Waiver together with the Minor consent form (Google Forms). Minor assent does not replace adult authorization. Parent or guardian presence is preferred where appropriate.
SECTION 11
Electronic acceptance and record
The Signer agrees to electronic acceptance and confirms the ability to access and retain this Waiver. The record may include the accepted version, Signer, Participant, relationship, service, timestamps, readiness, and emergency record. A later prospective version does not silently replace an earlier accepted version.
SECTION 12
Governing law, venue, and severability
Texas law governs to the extent it may lawfully do so. When a county-based venue provision is required and may lawfully apply, venue is Johnson County, Texas. If any provision cannot be enforced as written, it will be limited or separated only as necessary, and the remainder continues.
SECTION 13
Contact and acknowledgment
Questions may be sent to info@furiousstylez.net. Written legal notices may be sent to Furious Stylez LLC, 5900 Balcones Dr Ste 100, Austin, TX 78731-4298.
By accepting, the Signer confirms review and understanding of this Waiver; voluntary acceptance of the described risks and release within the stated limits; accurate information to the best of the Signer’s knowledge; and status as the adult Participant or authorized parent or legal guardian of the identified minor Participant.
